It mandates transparency, requiring notice to candidates about the use of AEDTs and their data retention policies. This law sets a precedent, indicating a clear move towards mandatory auditing and disclosure.

EEOC Guidance: The U.S. Equal Employment Opportunity Commission (EEOC) has also issued guidance, reiterating that existing anti-discrimination laws (like Title VII of the Civil Rights Act) apply to AI in hiring. They emphasize that employers remain responsible for any discriminatory outcomes, regardless of whether a third-party AI tool caused it. This means “the algorithm made me do it” is not a valid defense.

The EU AI Act: Across the Atlantic, the European Union is leading the charge with its comprehensive AI Act, set to be finalized soon. For any organization with a footprint in the EU, or hiring candidates from the EU, compliance will be non-negotiable.

These developments signify a pivotal shift. What were once considered “best practices” or voluntary ethical guidelines are rapidly transforming into legal obligations. HR leaders can no longer afford to be passive observers; proactive engagement with AI governance is now a core responsibility.
