- New York City Local Law 144 (Automated Employment Decision Tools – AEDT): This groundbreaking law, effective July 2023, requires employers using AEDTs for hiring or promotion to conduct independent bias audits annually and make the audit results publicly available. The ethical imperative is clear: companies using AI must ensure these tools enhance, rather than diminish, fairness and equity. Failure to do so exposes organizations to significant litigation, hefty fines, and severe reputational damage, impacting talent attraction and retention.

- Demand Vendor Transparency and Accountability: Don’t take vendor claims of “fairness” at face value. Ask detailed questions about their data sources, bias detection and mitigation strategies, validation methodologies, and transparency mechanisms. Request access to audit reports and be prepared to walk away from vendors who can’t meet your ethical standards.
- Develop Robust Internal AI Governance Policies: Establish clear, organization-wide policies for the ethical and responsible use of AI in HR. This includes defining principles (e.g., fairness, transparency, accountability, human oversight), establishing review committees (cross-functional with HR, Legal, IT, and DEI), and outlining specific processes for AI tool selection, deployment, and ongoing monitoring.
- Invest in HR Team Upskilling: Your HR professionals don’t need to be data scientists, but they do need a foundational understanding of AI, its potential for bias, and ethical considerations. Provide training on AI literacy, data privacy, and critical evaluation skills to empower them to be effective stewards of AI.
- Prioritize Human Oversight and Intervention: AI should augment human decision-making, not replace it. Design processes where human review and override capabilities are built into every stage of AI-assisted decisions, particularly in high-stakes areas like hiring, promotions, and performance management.
