- NYC Local Law 144: A pioneering piece of legislation, New York City’s Local Law 144, which took effect in July 2023, mandates independent bias audits for automated employment decision tools (AEDTs) used to screen candidates or employees for hire or promotion. It requires employers to publish audit results on their websites, along with the date of the most recent audit, and prohibits the use of AEDTs that haven’t undergone such scrutiny. This law set a precedent, requiring verifiable proof of fairness and transparency, rather than just good intentions.
- The EU AI Act: Poised to be one of the most comprehensive AI laws globally, the European Union’s AI Act classifies AI systems based on their risk level, with “high-risk” applications facing stringent requirements. Employment and worker management AI systems, particularly those used for recruitment, evaluation, and decision-making, are explicitly designated as high-risk. This means they will be subject to robust obligations concerning data governance, transparency, human oversight, cybersecurity, and conformity assessments before they can even be placed on the market. Non-compliance could lead to hefty fines, potentially in the tens of millions of euros or a percentage of global turnover.

- Establish Robust Internal AI Governance Policies: Develop clear internal guidelines for the ethical use of AI in HR. This should include policies on data privacy, human oversight, candidate rights, and an internal review process for new AI implementations. Consider forming an interdisciplinary AI ethics committee involving HR, legal, IT, and diversity & inclusion leaders.

Ensure that humans retain ultimate control, especially in critical areas like final hiring decisions.
