Though it’s a European law, its “Brussels Effect” means that companies operating internationally, or even those solely within the U.S. but serving clients globally, will likely need to align with its standards.
In the U.S., beyond the specific requirements like New York City’s Local Law 144 (which mandates independent bias audits for automated employment decision tools), federal agencies like the EEOC and DOJ are actively scrutinizing AI’s impact on civil rights laws. The potential for AI systems to create disparate impact or treatment under Title VII of the Civil Rights Act or the Americans with Disabilities Act (ADA) is a significant legal concern.
