Other states, like Illinois with its AI Video Interview Act, and broader privacy laws like California’s CCPA/CPRA, also impose significant restrictions and data governance requirements on AI systems.
- EEOC Guidance: The U.S. Equal Employment Opportunity Commission has repeatedly issued guidance clarifying that existing anti-discrimination laws (like Title VII, ADA, and ADEA) apply to AI and algorithmic decision-making. Employers are held responsible for discriminatory outcomes, even if unintended, emphasizing the need for proactive bias detection and mitigation.
- GDPR and Data Privacy: For companies operating with European data, the General Data Protection Regulation (GDPR) continues to impose strict rules on data collection, processing, and the right to explanation for automated decisions, which directly impacts AI in HR.
