The promises are compelling: reduced bias, increased efficiency, enhanced candidate experience, and data-driven decision-making. However, the dark side of unchecked AI deployment includes algorithmic bias perpetuating historical inequalities, a lack of transparency into decision-making, and potential infringements on privacy and data protection. What happens when an algorithm, built on biased historical data, systematically excludes qualified candidates from underrepresented groups? Or when a “black box” AI determines an employee’s career trajectory without clear justification? The EU AI Act: High-Risk AI in HR

The EU AI Act categorizes AI systems based on their potential to cause harm. Crucially for HR, systems used for “recruitment and selection of persons, in particular for advertising vacancies, screening or filtering applications, evaluating candidates or assessing candidates in the course of interviews or tests” and “workforce management, in particular for planning and assignment of tasks, monitoring, evaluation and appraisal of performance and behavior of persons in work-related environments” are explicitly classified as high-risk. This designation triggers a cascade of stringent requirements:

  • Risk Management System: Organizations must implement a robust system to identify, analyze, and mitigate risks throughout the AI system’s lifecycle.
  • Data Governance: Emphasis on high-quality training data to minimize bias and ensure accuracy.
  • Transparency and Information Provision: Users (both candidates/employees and HR professionals) must be informed that they are interacting with an AI system and understand its purpose and output.
  • Human Oversight: High-risk AI systems must be designed to allow for meaningful human oversight, preventing fully autonomous decision-making in critical areas.
  • Robustness, Accuracy, and Cybersecurity: Ensuring the AI system performs reliably, consistently, and securely.
  • Conformity Assessment: Before deployment, high-risk systems must undergo an assessment to ensure compliance with all requirements.
  • Post-Market Monitoring: Continuous monitoring of deployed AI systems to ensure ongoing compliance and address any emerging risks.

Non-compliance could lead to penalties reaching up to €35 million or 7% of a company’s global annual turnover, whichever is higher. Beyond the financial implications, the reputational damage of being found in violation of AI ethics is immeasurable in today’s transparent, socially conscious market.

  8. Develop a Human Oversight Protocol: For high-risk decisions, define clear processes for human review and intervention. Ensure that AI never has the final say in critical talent decisions without a qualified human in the loop.
