Companies operating globally, or those dealing with EU citizens, will feel its direct impact, setting a de facto global standard.

Closer to home, jurisdictions like New York City have led the way with laws such as NYC Local Law 144, effective mid-2023, which regulates the use of automated employment decision tools (AEDTs). It mandates bias audits, public disclosures, and transparency requirements for companies using AI in hiring or promotion decisions for NYC residents. Similar legislative discussions are underway at state and federal levels across the U.S., signaling a clear trend toward greater regulatory oversight of AI in HR.

These regulations force HR leaders to confront complex legal questions:

  • Discrimination: How do we prove an AI system isn’t perpetuating or amplifying bias, even unintentionally? Explainability helps identify the data points and decision logic contributing to an outcome, allowing for audit and correction.

  • Adverse Impact: Can an AI system be proven to have a disproportionately negative effect on certain protected groups? Regulations like NYC Local Law 144 specifically require bias audits to measure this.
